A national court decision limits how a generic condominium ban should be treated, but it does not remove the need to examine the actual documents or conduct. Lease, condominium convention and actual impact

A generic condominium ban is not the end of the analysis

In REsp 1.783.076-DF, the Superior Tribunal de Justiça held that a generic condominium restriction on keeping animals can be unreasonable where the animal does not present a risk to safety or tranquillity. The decision distinguishes silence in the convention, rules directed at animals that cause disturbance and an unsupported total prohibition. It is case-specific guidance, so the lease, convention, internal rules and actual effects on hygiene, health, safety and quiet still matter.

Scope: Brazilian condominium jurisprudence

Limit: The decision does not automatically invalidate every lease clause or condominium rule and arose from a specific dispute. Obtain qualified Brazilian advice before challenging a notice, fine, restriction or eviction action.

Read the documents and plan around actual impact

Obtain the lease, convenção and regimento interno, then identify what each provision governs. Walk the entrance, lift, stairs and shared areas, and plan handling, cleanup and noise. Describe the dog accurately, retain written clarification and seek qualified advice if a restriction or complaint is disputed.

SinPatinhas and mandatory local records

SinPatinhas is a voluntary national digital record

The federal SinPatinhas service allows a responsible person to register a dog or cat, issue a digital Animal ID with a QR code and record events such as a change of responsible person. The service is free and voluntary. It can also track microchipping, vaccination and other health procedures, although some entries must be made by a veterinarian. A SinPatinhas record does not by itself replace a registration required by a state or municipality.

Scope: Brazil, SinPatinhas national register

Limit: Keep the responsible-person and contact data current and distinguish self-entered information from veterinary entries. Check the state and municipality for compulsory identification, vaccination, licence, tag or record duties.

São Paulo requires a separate municipal RGA

The City of São Paulo says every resident dog and cat over three months old must have a Registro Geral do Animal. The application requires responsible-person identification, a current proof of address, the animal's photo and proof of rabies vaccination, and it produces a digital card plus a numbered identification tag that should remain on the collar. This local RGA duty is separate from the voluntary federal SinPatinhas record.

Scope: City of São Paulo

Limit: This is a São Paulo city example, not a Brazilian municipal standard. Confirm the responsible local authority, eligibility, documents, tag, vaccination, transfer and address-update procedure for the actual residence.

Layer the national record with the mandatory local one

Check the municipality first, then list every required record and the evidence attached to it. In São Paulo, complete the RGA and keep its tag on the collar; use SinPatinhas as a separate national record if desired. Update responsible-person, address, vaccination and microchip details in each applicable system after a move or transfer.

Why it matters
Completing one digital record can create false confidence that every local identification and vaccination requirement is satisfied.

Municipal rules and the route outside

São Paulo municipal parks require a lead outside designated dog areas

São Paulo's Portaria SVMA 79/2023 requires domestic animals in municipal parks managed by SVMA to be conducted with a collar and lead suitable for their size and build. The stated exception is a place designated for that purpose, such as a cachorródromo or parcão. The individual park's entrance signs, excluded spaces, opening hours and current site conditions still determine whether a mapped green space works for the daily route.

Scope: São Paulo municipal parks managed by SVMA

Limit: This is a City of São Paulo park example, not a national rule. Check the manager, signs and local legislation for the actual park, square, conservation area, beach or private condominium space.

Verify the route and the boundary of the dog area

Walk the complete route and inspect signs. Record condominium exits, crossings, lead status, the exact dog-area boundary, cleanup points, shade, water, lighting and hours. Keep a permitted on-lead backup and give both routes and the dog's control plan to every caregiver.

Why it matters
A green space or parcão marker on a map does not show the rules at the entrance or the full route through shared and public space.

The municipality and site manager, entrance signs, collar and lead, designated dog-area boundary, cleanup, exclusions, private common areas, shade, water, hours and backup route.

Metro time, weight, carrier and connections

São Paulo Metro limits pets by time, weight and carrier

Metrô de São Paulo permits a domestic animal weighing no more than ten kilograms when it is inside a suitable, clean transport box and the journey does not compromise passenger comfort, safety or operations. Pet travel is excluded on weekdays from 06:00 to 10:00 and from 16:00 to 19:00, while weekends and holidays are available throughout commercial operation. Guide dogs have a separate all-day exception.

Scope: Metrô de São Paulo under the cited state-law conditions

Limit: Confirm current hours, carrier, weight, guide-dog arrangements and the exact line operator before travel. Buses, CPTM, private hire, intercity services, airlines and replacement transport may use different rules.

Match the dog and appointment to the exact operator window

Weigh the dog with the practical carrier in mind, check both journey times and identify every operator. Confirm the carrier, accessibility and assistance conditions, practise before travel and keep a pet-accepting taxi or private-hire alternative for urgent care and the return trip.

A route that works at midday can fail for a heavier dog, an early appointment, a peak-hour return or a connection run by another operator.

CVI or accepted passport and arrival inspection

Entry requires an official document meeting Brazil's health conditions

MAPA states that a dog or cat entering Brazil must be accompanied by a Certificado Veterinário Internacional or an official passport issued or endorsed by the veterinary authority in the country of origin and meeting Brazil's health requirements. The current page links the requirements under Portaria MAPA 741/2024 and the CVI model that became mandatory in September 2025. Arrival documentation is subject to agricultural surveillance at the point of entry.
